Acceptable Use Policy

This Acceptable Use Policy (the "Policy") describes the rules governing your use of Folium Hosting's ("Company," "We," "Us," or "Our") services ("Services"). It supplements, and forms part of, our Terms of Service. By accessing or using our Services, you agree to comply with this Policy. Violation of this Policy may result in suspension or termination of your Services, as described in Section 9 below and in our Terms of Service.

This Policy exists to protect our infrastructure, our clients, and the general public from misuse. It is not exhaustive; we reserve the right to take action against any use of our Services that we reasonably determine to be harmful, illegal, or abusive, even if not explicitly listed here.

1. Prohibited Content and Activities

You may not use our Services to store, host, transmit, or distribute content or engage in activity that:

  • Is illegal under the laws applicable to you, to us, or to the jurisdictions of the Netherlands.
  • Infringes on the intellectual property, trademark, copyright, or other proprietary rights of any third party, including pirated software, cracked applications, or unlicensed copyrighted media.
  • Constitutes malware, ransomware, spyware, or any other malicious code, or is used to develop, test, or distribute such code without prior written authorization from us.
  • Facilitates phishing, identity theft, credential harvesting, or other fraudulent schemes.
  • Depicts or facilitates child sexual abuse material (CSAM) in any form. Such content will be reported to the National Center for Missing & Exploited Children (NCMEC) or the relevant law enforcement authority without prior notice to you.
  • Promotes or incites violence, terrorism, or hatred against individuals or groups based on protected characteristics.
  • Is defamatory, harassing, or violates the privacy rights of any individual.
  • Facilitates the sale or distribution of illegal goods or services, including controlled substances or unregulated weapons.

2. Network and Security Abuse

The following activities are strictly prohibited on or through our network:

  • Launching or participating in Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks against any target, including our own infrastructure.
  • Unauthorized port scanning, vulnerability scanning, or penetration testing of systems you do not own or do not have explicit written permission to test, whether targeting our infrastructure or third parties.
  • Attempting to gain unauthorized access to any system, account, network, or data, including through brute-forcing, credential stuffing, or exploitation of vulnerabilities.
  • IP spoofing, packet sniffing, or intercepting network traffic not intended for you.
  • Operating open proxies, open mail relays, or open DNS resolvers that can be leveraged for abuse.
  • Circumventing or attempting to circumvent resource limits, security controls, licensing restrictions, or isolation mechanisms (e.g., container/VM sandboxing) put in place on our platform.
  • Cryptocurrency mining or staking on shared infrastructure, unless explicitly permitted for the specific service/product you purchased and disclosed to us in advance.

If you discover a security vulnerability in our Services, you must report it to us promptly through our official support channels and must not exploit it or disclose it publicly before we have had a reasonable opportunity to remediate it.

3. Spam and Unsolicited Communications

You may not use our Services to send unsolicited bulk or commercial email, messages, or notifications ("spam"), including via email, Discord, SMS, or any other messaging medium. This includes, but is not limited to:

  • Sending bulk email without the verifiable consent of every recipient, or in violation of applicable anti-spam laws (e.g., CAN-SPAM, GDPR, CASL).
  • Harvesting email addresses, phone numbers, or Discord user IDs without consent for the purpose of sending unsolicited messages.
  • Operating a Discord bot or automated system to mass-message, raid, or spam users or servers without consent.
  • Using our Services to relay or forward spam originating elsewhere.

4. Resource Usage and Fair Use

Shared Services are provided with resource allocations (CPU, RAM, disk, network bandwidth) intended for the typical, good-faith operation of the product you purchased. Detailed fair usage limitations, including database connection and storage limits, are set out in Section 9 (Fair Usage) of our Terms of Service. Using allocated resources for purposes unrelated to the intended operation of your service (for example, using a game server slot as general-purpose file storage, a media server, or a public file-sharing host) is considered abuse under this Policy.

5. Service-Specific Restrictions

Minecraft Server Hosting:

  • Hosting files, plugins, mods, or applications unrelated to the operation of a Minecraft server.
  • Unauthorized large-scale file storage or backups unrelated to Minecraft server operation.
  • Hosting malicious, cracked, or nulled plugins/mods, or plugins that facilitate cheating or exploitation of other servers.

Discord Bot Hosting:

  • Hosting files or applications unrelated to the operation of a Discord bot.
  • Operating bots in violation of Discord's Terms of Service, Developer Policy, or Community Guidelines.
  • Using bots to spam, harass, raid, or otherwise disrupt Discord servers or users.
  • Using bots for phishing, malware distribution, token grabbing, or other illegal or malicious activity.

Game Server Hosting (General):

  • Attempting to host games not explicitly supported or permitted under your purchased plan, unless we have given prior written approval.
  • Hosting illegal content or mods that facilitate illegal activity, cheating in third-party services, or circumvention of anti-cheat systems.
  • Using the service primarily for large-scale file storage or backups unrelated to game server operation.

Activities not explicitly listed above but reasonably deemed by us to constitute abuse, or to violate the spirit of this Policy, may also result in enforcement action under Section 9.

7. Monitoring and Investigation

We do not proactively monitor the content of your services as a matter of course; however, we reserve the right to investigate suspected violations of this Policy, including reviewing account activity, network traffic patterns, and, where necessary and permitted by law, the content stored on our Services. We may cooperate with law enforcement and regulatory authorities to investigate and prosecute violations of this Policy.

8. Reporting Violations

If you become aware of a violation of this Policy, including abuse originating from our network, please report it to us via a support ticket in our billing area, by email at [email protected]. Please include as much detail as possible, such as affected IP addresses, timestamps, logs, and a description of the activity observed, to help us investigate promptly.

9. Consequences of Violations

Violations of this Policy may result in one or more of the following actions, at our sole discretion and proportionate to the severity of the violation:

  • A warning and request to remediate the issue within a reasonable timeframe.
  • Temporary suspension of the affected Service.
  • Filtering, null-routing, or restriction of specific traffic or IP addresses associated with the violation.
  • Permanent termination of the affected Service or your account, without refund, as described in our Terms of Service.
  • Removal or disabling of access to the offending content.
  • Referral to law enforcement or other applicable authorities where required or appropriate.

Severe violations (e.g., CSAM, active attacks, illegal activity) may result in immediate suspension or termination without prior warning. We are not liable for any loss of data or service resulting from action taken in good faith to enforce this Policy.

10. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices, infrastructure, or legal requirements. We will notify you of significant changes by posting the revised Policy on this page and updating the "Last revised" date, and where appropriate via email or client area notification. Your continued use of our Services after such changes take effect constitutes your acceptance of the revised Policy.
